The judiciary in India plays a crucial role in maintaining the balance of power among the three branches of government: the legislature, the executive, and the judiciary itself. Rooted in the Constitution, the Indian judiciary acts as the guardian of justice, protecting the rights and freedoms of its citizens.
Central to the Indian judicial system is the principle of independence. The judiciary operates autonomously, free from any external influence or interference. This independence is enshrined in the Constitution, ensuring that judges can impartially adjudicate matters and uphold the rule of law without succumbing to political pressures.
The significance of an independent judiciary cannot be overstated. It acts as a safeguard against tyranny, holding the government accountable and preventing the concentration of power in any one institution or individual. By serving as a check on the legislative and executive branches, the judiciary ensures the fair and consistent application of laws, safeguarding citizens' rights against encroachment by the state.
Moreover, the independence of the judiciary is vital for maintaining public trust and confidence in the legal system. When citizens perceive the judiciary as fair, impartial, and free from external influence, they are more likely to respect its decisions and abide by the rule of law. This fosters stability and confidence in the democratic process, which is essential for the progress and development of the country.
In India, the judiciary has demonstrated its commitment to upholding its independence and asserting its authority through landmark cases. From safeguarding fundamental rights and liberties to interpreting and enforcing constitutional principles, the judiciary has played a central role in shaping the country's legal landscape.
The verdict in Kesavananda Bharati v. State of Kerala (1973) by the Supreme Court is a prime example of this.
